Strategies in employment dispute resolution

Jessie and Caitlin from Duncan Cotterill will take attendees through the various methods of dispute resolution, from having constructive informal discussions with employees, to undertaking effective mediations and negotiations at the later stages of a dispute. 

They will cover:
- Exploring effective resolutions at each stage of a dispute 
- Preparing for an effective and constructive mediation 
- When, how and why to explore ‘without prejudice’ discussions 
- Settlement strategies and negotiation techniques, and 
- Practical tips for managing difficult scenarios.

For any HR practitioners who are interested in a refresher on resolving employee relations matters effectively and constructively.

Presenter Details

Jessie Lapthorne - Partner, Duncan Cotterill

Jessie is a partner in the employment and health and safety team and is based in Auckland. She has 20 years’ experience as an employment law specialist, in both New Zealand and the United Kingdom. Jessie is an experienced litigator, regularly appearing in the Employment Relations Authority and the Employment Court. Jessie’s expertise spans the full spectrum of workplace law, including disciplinary and performance matters; restructuring and redundancy procedures; personal grievances; restraint of trade disputes; protection of confidential information; health and safety; and human rights issues; where her input ranges from front-end guidance, to dispute resolution and advocacy.

Caitlin Sargison - Associate, Duncan Cotterill

Caitlin specialises in employment law, advising on a range of matters including resolution of disputes, managing complex staff issues and dealing with challenging employee conduct. She assists employers of all sizes across diverse industries. She advises on discrete employment issues such as managing disciplinary, investigation, restructuring and performance processes, as well as day-to-day/business as usual matters like contractual and policy advice.
